A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his return to the United States to face human smuggling allegations, he was detained in federal custody.
In her order, the court pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
